| dc.description.resumo | Discussing intent as well as guilt in the crime of homicide in traffic under the influence of alcohol is to understand the advances that the doctrine has brought to this crime that is often seen in everyday life. Therefore, this work is justified by the relevance in the in-depth study on the proposed theme, as it is a crime still with doctrinal currents and controversial jurisprudence, where non-pacified cases leave the criminal without adequate punishment for the conduct. This work will be delimited with the following question: what will define the crime of homicide in traffic in relation to intent and guilt? In order for this question to be properly answered, the author limited the work to general and specific objectives, the general objective being the demystification of the topic addressed and the specific ones will be, to discuss the evolution and concept of intent and guilt in relation to the highlighted crime, the legal and doctrinal analysis on the present theme and the correlation of the current law with the old one. Finally, the author used the descriptive methodology based on Laws, pacified doctrines for and against the proposed theme as well as websites and judgments. | En |

| dc.description.abstract | Discutir sobre o dolo bem como a culpa no crime de homicídio no trânsito sob o a influência do álcool é compreender os avanços que a doutrina vem trazendo para esse crime que muito se vê no dia a dia. Portanto, este trabalho tem como justificativa a relevância no estudo aprofundado sobre o tema proposto, pois trata-se de crime ainda com correntes doutrinárias e jurisprudências, onde casos não pacificados deixam o criminoso sem a punição adequada para a conduta. Esse trabalho será delimitado com a seguinte pergunta: o que definirá o crime de homicídio no trânsito em relação ao dolo e a culpa? Para que essa pergunta seja devidamente respondida a autora limitou o trabalho em objetivos gerais e específicos, sendo o objetivo geral a desmistificação do tema abordado e os específicos serão, discorrer sobre a evolução e o conceito do dolo e da culpa em relação ao crime destacado, a análise jurídica e doutrinária sobre o presente tema e a correlação do direito atual com o antigo. Por fim a autora se utilizou da metodologia descritiva com fundamentos em Leis, doutrinas pacificadas a favor e contra ao tema proposto bem como sites e julgados. | en_US |
